  • “Client,” “You,” or “Your” refers to any person, business, or organization using our services.
  • “Services” refers to digital marketing solutions offered by Digital Tusk, including but not limited to SEO, social media marketing, PPC campaigns, content marketing, email marketing, and related consulting.

2. Eligibility

By using our services, you confirm that you are at least 18 years old and legally capable of entering into binding contracts.

3. Services Provided

Digital Tusk offers digital marketing solutions tailored to client needs. The scope, timeline, and deliverables of each project will be detailed in a separate Service Agreement or proposal accepted by both parties.

4. Client Responsibilities

You agree to:

  • Provide accurate information required for the execution of services.
  • Grant necessary access to accounts, platforms, and resources (e.g., websites, social media accounts, analytics).
  • Ensure all content provided (images, text, logos, etc.) is legally owned or properly licensed.
  • Respond promptly to requests for feedback, approvals, or additional information.

5. Payments & Billing

  • All fees will be outlined in the Service Agreement or invoice.
  • Payments must be made within the agreed timeline. Late payments may result in service suspension or additional charges.
  • Fees paid for services are non-refundable, unless otherwise stated in writing.

6. Intellectual Property

  • All strategies, reports, creatives, and materials produced by Digital Tusk remain the intellectual property of Digital Tusk until full payment is received.
  • Upon full payment, ownership of deliverables (excluding proprietary tools, templates, or software) will transfer to the Client.
  • Clients grant Digital Tusk the right to use their logo and project details in our portfolio and marketing materials unless otherwise agreed.

7. Confidentiality

Both parties agree to keep confidential any non-public business, technical, or financial information obtained during the course of the engagement, unless disclosure is required by law.

8. Limitation of Liability

  • Digital Tusk will make every effort to provide high-quality services, but we do not guarantee specific business outcomes (e.g., sales, ranking positions, conversions).
  • We are not responsible for indirect, incidental, or consequential damages resulting from the use of our services.

9. Termination

Either party may terminate the agreement by giving written notice of at least 7 days.
Digital Tusk may terminate services immediately if:

  • Payments are not received on time.
  • The Client violates these Terms & Conditions.
  • The Client engages in unlawful, unethical, or harmful practices.

10. Third-Party Services

Our services may involve the use of third-party platforms (e.g., Google Ads, Facebook, LinkedIn). Digital Tusk is not responsible for downtime, errors, or changes in policies by third-party providers.

11. Indemnification

You agree to indemnify and hold harmless Digital Tusk, its employees, and partners from any claims, damages, or losses resulting from:

  • Misuse of our services.
  • Violation of third-party rights.
  • Breach of these Terms & Conditions.

12. Governing Law

These Terms & Conditions shall be governed by and construed under the laws of Indian Judicial System. Any disputes will be subject to the exclusive jurisdiction of the courts in Bengaluru.

13. Changes to Termsi

We may update these Terms & Conditions from time to time. Updates will be posted on our website with the revised effective date. Continued use of our services constitutes acceptance of the updated terms.
